Judge should Ban Kalla Thuppaki and set an example to avoid such defaming petitions
It is becoming easy for small-time directors, script-writers and producers to target big movies. This has been happening predictably for big release movies. The petitioners usually gain an upper hand since they have nothing to lose. Unfortunately, the laws are unfavorable against big movies. We saw similar petitions against Dasavatharam, Enthiran and other prominent movies.
Senseless Petition against Thuppakki
Vijay and AR Murugadoss' Thuppakki is the latest one to be impacted by inappropriate petitions. In a petition filed by K.C. Ravidevan of North East Film Works Film Factory, he alleged that he had registered the title "Kalla Thupakki" with Film Chamber in 2009. But the petitioner claimed that the producers of Thuppakki mis-used the influence of SAC to register the title.
Questionable Court Ruling
Based on this Chennai City Civil Court has restricted the makers of Thuppakki, which is being directed by A R Murugadoss, from using "Thuppakki" title till July 16. Such rulings will only encourage more such petitions by miscreants against big movies which will eventually distract Tamil movie makers as they try to fight such meaningless legal battles.
- As common people know, this is a baseless accusation made by "Kalla Thuppakki" to get instant publicity. First of all, there are so many movies with portions of title -- Manmadhan Ambu & Manmadhan, Dasavatharam and Avatharam, Kallakadhalan, kalabakadhalan & kadhalan, etc. There are innumerable examples one can find with Tamil movie names. With such strong precedence, why "KallaThuppakki" and "Thuppakki" is a non-starter and should have been squashed the petition after the first hearing.
- However, there is striking similarity between the title lettering design of "Thuppakki" and "Kalla Thuppakki" (as seen in the above picture). After some investigation, it was found that the posters of "Kalla Thuppakki" showed up on the internet only after May 4th. It is much after the "Thuppakki" title was officially released. Hence, it is "Kalla Thuppakki" that should be sued and banned for copying from Thuppakki.
Kalla Thuppakki should be heavily punished
Despite all the negative press, these issues will not have major impact on "Thuppakki". When a common man understands this is a publicity gaining effort by "Kalla Thuppakki", why is the court not taking a tough stance by placing heavy fines and warnings against the "Kalla Thuppakki" petitioners for copying the title design from "Thuppakki", which is clearly a copyright issue beyond any doubt. It is unfortunate to see such small-time producers holding the big movies as hostage with such cheap tactics.
